Terms & Conditions

GEKO MUSIC IN-SCHOOL PROGRAM & GEKO MUSIC ACADEMY

The following sets out the terms and conditions of enrolment in the GEKO Music Guitar & Ukulele Tuition & Orchestral Program (“GEKO”) by Geko Music Pty Ltd (“Geko Music”) (the “Terms and Conditions”). Payment of fees and/or your child’s attendance at a Lesson is deemed acceptance of these Terms and Conditions

1. The Guitar & Ukulele Tuition & Orchestral Program
a) GEKO is an independent children’s instrumental tuition
program run and administered by Geko Music Pty Ltd.
b) GEKO runs at the GEKO Music Academy (“Academy”) and at
participating schools (“In-School”).


2. Tuition Program Eligibility
Geko will accept enrolment requests for ukulele and guitar tuition
from students at the following venues as follows:
a) Academy: Kindergarten to year 7 (“K-7”)
b) In-Schools: Kindergarten to year 6 (“K-6”)


3. Orchestra Program Eligibility
a) Academy Senior Orchestra (By Audition only).
i. Geko accepts audition requests from GEKO and non-GEKO
students in K-12.
b) Academy Junior Orchestra (By Invitation only).
ii. Advance GEKO students (and non-GEKO K-12 students
who do not pass the Concert Orchestra audition) may be
invited to join the GEKO Junior Orchestra. Invitation is at the
sole discretion of GEKO.
c) In-School Orchestra (By Invitation only).
iii. Advance GEKO In-School students may be invited to join the
GEKO In-School Orchestra. Invitation is at the sole
discretion of GEKO.


4. Orchestra Members Responsibilities
All GEKO Orchestra musicians will need to:
a) attend weekly 1-hour rehearsals
b) show ongoing improvement in instrument ability
c) regularly practice & study the Orchestra’s repertoire
d) display appropriate conduct during rehearsals
e) bring a clip-on electronic tuner to all engagements and
rehearsals and be able to tune their instruments in under 30
seconds.


5. Applications for Enrolments
a) Enrolment requests are accepted online and places allocated
based on availability and upon the receipt of fees.


6. Confirmation of Enrolment
a) Enrolments are confirmed upon receipt of full payment of Fees,
at which time students will be able to commence their Lessons.
b) If choosing to be invoiced for lessons, should payment not be
received by the invoice due date, your child’s spot in the Class
may be released without further notice to you. Due to the
popularity and limited spaces in GEKO, spots cannot be held
beyond the invoice due date.


7. Program Fees (“Fees”)
a) Geko Music calculates the fees based on the number of school
weeks per term (excluding any public holiday). These fees are:
i. charged as full-term fees payable in advance to Geko
Music P/L; and
ii. non-refundable for absences or cancellations.
b) GEKO schedule of tuition fees are as follows (GST Incl):
i. $17 per group lesson
ii. $11 per orchestra rehearsal
iii. $29 for each tuition book;
iv. $29 one-off Introduction to Orchestra Lesson;
v. $29 one-off Introductory Beginner Lesson; and
vi. $7 per pack of 5 picks,
c) The enrolment Fees payable will be dependent upon the
number of Lessons in the term, and other incidental costs such
as books and picks as necessary for your child.
d) Fees are invoiced in advance and are payable by the invoice
due date or before the start of the first lesson, whichever comes
first.

e) Geko Music provides electronic invoices to the email address
nominated on the Online Program Enrolment Request Form.
f) All Classes are in high demand with limited availability. Failure
to settle tuition fees by their due date may result in the loss of
your child’s place in the Class. Geko Music reserves the right
in such instances to offer unpaid spots to other students on
GEKO’s waitlist without further notice to you.


8. Payment of Fees
a) Fees can be paid via Credit Card upon online enrolment
(subject to spot availability) or, if an invoice has been issued,
by Electronic Funds Transfer to Geko Music’s nominated bank
account as stated on invoices. No other form of payment will be
accepted.


9. Waitlist
a) Should a GEKO Class reach capacity, enrolments will continue
to be taken and placed on a waitlist in the order received. You
will be notified if your child is added to the waitlist. An invoice
for payment of fees is only issued when a spot becomes
available in the preferred Class.
b) Upon notification, you will be issued with an invoice for fees
payable and full payment of these fees will be required within
three (3) business days or prior to attendance at the first lesson,
whichever comes first.
c) If payment is not received within 3 business days, it will be
deemed notice that you do not wish to accept the offer and the
spot will be offered to the next child on the waitlist.


10. Re-enrolment in GEKO
a) Existing GEKO students have priority over new enrolment
applications and will be automatically re-enrolled for future
terms in the same Class just completed and fees calculated and
invoiced accordingly.
b) You are not obligated to re-enrol your child if you choose to
discontinue tuition.
c) Prior advise or non-payment of a re-enrolment invoice by the
due date will be taken as notice of cancellation and the Class
spot will be offered to others on the waitlist.


11. Introductory Beginner Lesson Fee (“IBL Fee”)
a) New/first-time GEKO students will be required to attend a oneoff
Introductory Beginner Lesson (“IBL”) to quickly integrate
them into an already-established tuition group.
b) The IBL must be completed prior to your child’s first GEKO
Lesson. Geko will notify you of available time slots for an IBL
prior to your child’s first Lesson. If your child has not completed
an IBL they will not be permitted to commence Lessons and you
will forfeit the Fees in respect of such Lessons.


12. Introduction to Orchestra Lesson Fee (“IOL Fee”)
a) New Orchestra students are required to attend a one-off
Introduction to Orchestra Lesson (IOL) to quickly integrate them
into the orchestra.
b) The IOL must be completed prior to your child’s first GEKO
Orchestra Rehearsal. Geko will notify you of available time slots
for an IOL prior to your child’s first Rehearsal. If your child has
not completed an IOL they will not be permitted to commence
Rehearsals and you will forfeit the Fees in respect of such
Rehearsals.



13. Missed Lesson by Student
a) In the event that your child misses a Lesson for any reason
other than cancellation of the Lesson by Geko Music, you forfeit
the Fee in respect of that Lesson. While Geko Music does not
provide make-up Lessons nor credit any Fees for a missed
Lesson, upon request by you, Geko Music will endeavour to
accommodate your child in an alternate class of similar level
only if spaces are available in that class. Please note that this
may not be possible if all classes are full in which case you will
forfeit the fee in respect of the missed lesson.

14. Lesson or Class Cancellation by Geko Music
a) In the unlikely event that a Lesson is cancelled by Geko Music,
Geko Music will advise you in writing, by email or text
message, and offer the following options in lieu of the
cancelled Lesson:
i. an alternative class; or
ii. a full refund in respect of the cancelled Lesson
processed by EFT to a nominated bank account; or
iii. a credit towards next term Fees.
b) You are to notify Geko in writing (email or text) within 3
business days of receipt of notice of cancellation whether you
wish to accept the alternative class, a refund or a credit
accordingly.
c) If Geko Music does not receive notification of your preferred
option within the time period specified above, a credit will be
applied automatically in the next invoice in respect of Fees for
future GEKO terms.
d) In the event that a Class is cancelled by Geko Music you will
be offered the opportunity to transfer your child into another
Class or to receive a refund in respect of all Lessons
remaining in the term, at your election.


15. Instruments
a) Geko does not provide instruments. Children must bring their
own guitar or ukulele, as applicable, to each Lesson.
b) Geko does not take responsibility, under any circumstance,
for any loss or damage to a child’s instrument.

16. Child Supervision Before and/or After GEKO Lesson
a) For In-School Program - Geko Music does not provide child
supervision before or after each Lesson.
b) For Academy Program - Parents or carers must remain on
venue grounds during their child’s scheduled lesson.

17. Rights in GEKO Materials
a) Geko Music Pty Ltd owns all rights (including copyright) in all
materials designed, produced and provided in connection with
the GEKO. All training material, including classroom training
manuals, handouts, training exercises and publications are
protected by copyright, and cannot be used in any form,
including digitized, photocopied, otherwise reproduced,
posted, or transmitted, in whole or in part, without the prior
written consent of Geko Music. All intellectual property rights,
whether registered or unregistered anywhere in the world,
including and without limitation, all copyright, trade secrets,
patents, patent applications, trademarks, domain names,
business names and design rights are and remain the sole
property of Geko Music.
b) All materials used in the GEKO are for the exclusive use by
Geko Music. No other party is authorised to use the materials
in whole or in part without the prior written consent of Geko.
c) By paying the Fees, you are granted the right to use the
Materials solely in connection with the Lessons and your
child’s own private study. Neither you nor your child may use
the materials for any other purpose at any time, including as

part of lessons with another tuition provider.

18. Loss and/or Damage of Personal Property
a) Geko Music expressly disclaims any liability in respect of the
loss and/or damage of any personal property (including,
without limitation, any instruments or other musical
equipment) suffered at or in connection with a Lesson.
b) Any personal property left at a Lesson will be retained by Geko
Music for a period of 14 days and Geko Music will use
reasonable efforts to contact you in respect of such property
using the contact information set out on the Online Program
Enrolment Form. If you have not collected any lost item within
the 14-day period Geko Music may donate the item to charity
or otherwise dispose of the item, at its discretion.

19.Trial Lessons
a) Trial lessons are permitted based on availability and at the
sole discretion of GEKO MUSIC.
b) The trial lesson is free of charge if the student subsequently
does not enroll.
c) If, after a trial lesson, the student enrolls to continue tuition in
the group classes, tuition fees will apply and include fees as
outlined in Clauses 7 and 11 above and the trial lesson will be
deemed an Introductory Beginner Lesson (IBL) and charged
as outlined in clause 7bv above.

20. Photography & Video:
All GEKO Orchestras are ensembles which performs to a wider
audience within and outside participating GEKO schools’
grounds, GEKO Academy and for the general public. Your child’s
participation in a GEKO Orchestra may be filmed, recorded or
photographed by Geko Music.
You acknowledge and agree that:
a) all rights, title and interest in and to such photographs and
videos will be owned by Geko Music and that Geko Music shall
have an unfettered right to use such photographs and videos
worldwide and in perpetuity.
b) your child’s image as represented in the photographs or
videos may be used by Geko Music in connection with the
marketing and promotion of Geko Music and its related bodies
corporate and their assigns, and their associated businesses
worldwide and in perpetuity.
c) Geko Music Pty Ltd will not disclose your child’s name or other
personal information in connection with any use of relevant
materials in connection with this Clause. All material will
remain the property of Geko Music Pty Ltd.

21. These Terms and Conditions May Be Updated from Time toTime
a) Geko Music reserves the right to change these Terms and
Conditions at any time, and any amended Terms and
Conditions are effective upon posting to the Geko Music
website located at www.gekomusic.com.au. Geko Music will
make every effort to communicate any significant changes to
you via email using the contact details provided in the Online
Program Enrolment Request Form.
b) Your child’s continued attendance at Lessons will be
deemed acceptance of any amended Terms and Conditions.
